“Pedal Your Way To Wellness” Sweetstakes Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN ELIGIBILITY
The “Pedal Your Way To Wellness” Sweepstakes (“Sweepstakes”) runs between 12:01 AM Pacific Standard Time (“PST”) on May 1st, 2011 and 11:59 PM PST on August 15th, 2011. Open to legal residents of the 50 United States and the District of Columbia, age 18 and older. Employees of Steviva Brands and their respective parents, affiliates, subsidiaries, advertising and promotional agencies and the immediate family members of each are not eligible to enter the Sweepstakes. Sweepstakes is void wherever prohibited or restricted by law and is subject to all applicable federal, state, and local laws.
HOW TO ENTER ONLINE SWEEPSTAKES REGISTRATION:
Only one (1) entry per person per email address for the duration of the Sweepstakes. You can receive one (1) additional entry for each person you refer to the sweepstakes, who enters the sweepstakes using your customized referral link generated at http://www.vibeincentives.com/steviva-sweetstakes/ (“Referral Entry”). All Entries must be received by August 15th, 2011 11:59PM PST to qualify for entry into the Sweepstakes. Proof of online entry or of posting does not constitute proof of delivery. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. All entries become the property of Sponsors and will not be acknowledged or returned.
PRIZES
Grand Prize: One (1) Grand Prize to be won, consisting of : a Trek Madone 3.1 Road Bike in your chosen size. Approximate Retail Value of Grand Prize: $2,225.00 . Two (2) Second prizes consisting of KitchenAid mixers . Approximate retail value of secondary prize: $300 each. Ten (10) third prizes of $50 Steviva Brands gift certificates to be used in the Steviva Brands on-line store only. Approximate retail value of all prizes is $3,325.00. All taxes and all other expenses not expressly specified herein as part of the prizes are the sole responsibility of the winners. Prizes are non-transferable and may not be substituted or redeemed for cash. Restrictions may apply on any prize. Sponsors reserve the right to substitute a prize for one of equal or greater value. No more than one prize per entrant. Prize details not specifically set forth herein are at Sponsors’ sole discretion. Winner is solely responsible for any costs incurred in claiming, registering, or using a prize. All federal, state, local, municipal laws and regulations apply.
WINNER SELECTION/NOTIFICATION
All potential winners will be selected for all prizes by an independent judging organization in a random drawing from among all eligible entries on or around August 14th, 2011. Potential winners will be notified by email and/or phone within seven (7) days from the DRAWING date. In the event that a potential winner cannot be notified within ten (10) days after notification attempt, or does not reply within ten (10) days to the notification attempt, or if a potential winner fails to comply with any requirement of these Official Rules, then that potential winner’s prize will be forfeited, and an alternate potential winner may be selected at random from the remaining eligible entries received. All Prizes will be awarded within 60 days of winners’ acceptance of prize. Odds of winning depend on the number of eligible entries received. Winner will be required to sign an affidavit of eligibility and a liability/publicity release (unless prohibited) and return documents in the time specified.
AGREEMENT TO OFFICIAL RULES
By entering the Sweepstakes, each entrant fully and unconditionally agrees to be bound by these Official Rules and by the decisions of the independent judging organization which are final on all matters pertaining to the Sweepstakes. The Sweepstakes is governed by the laws of the state of Oregon, whose courts shall have non-exclusive jurisdiction in respect of any dispute arising.
PUBLICITY
Participation in the Sweepstakes constitutes each winner’s permission for Sponsors to use such winner’s name, likeness, hometown and biographical information for advertising and promoting this Sweepstakes without additional compensation unless prohibited by law.
RELEASE
By entering the Sweepstakes, each entrant fully and unconditionally releases and holds harmless Sponsors and their parents, affiliates, subsidiaries, directors, officers, employees and its advertising, promotional and judging agencies from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Sweepstakes or receipt, redemption, use or misuse of any prize won, except to the extent that this release may be limited by applicable law.
GENERAL
Entries generated by a script, macro, or other automated means will be disqualified. Sponsors, any telephone network, service providers and Steviva Brands are not responsible for any problems or technical malfunction of any telephone network or lines, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any Web site or on-line service, or any other error or malfunction, or late, lost, illegible or misdirected entries. Entry materials that have been tampered with or altered are void. If the judges determine, in their sole discretion, that there is any suspected or actual electronic tampering with the Sweepstakes or if technical difficulties compromise the integrity of the Sweepstakes, the judges reserve the right to void the entries at issue and/or terminate the Sweepstakes and conduct a random drawing to award the prizes among all eligible entries received as of the termination date. If the Sweepstakes is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at www.steviva.com/pedalyourway . If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsors reserve the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Sponsors reserve the right to disqualify any entrant that tampers with the operation of the Sweepstakes or website or violates the Official Rules of the Sweepstakes. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES OR THIS WEBSITE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
